General Terms and Conditions of Use (GTCU)

Preamble

These General Terms and Conditions of Use ("GTCU") govern access to and use of the services offered by By-Hoster, an association declared under RNA number W162005815 and registered under SIRET 92395660100010, whose registered office is located in Nouvelle-Aquitaine, France.

Any use of the services implies full acceptance of these GTCU.

Article 1 – Purpose

These GTCU are intended to govern the terms of access, registration, use and operation of the services provided by By-Hoster via its website www.by-hoster.net.

By-Hoster exclusively provides hosting services and disclaims any responsibility for the content hosted or its use by third parties.

Article 2 – Definitions

• By-Hoster: Refers to the publishing association and service provider.
• Services: All services provided by By-Hoster (hosting, data storage, etc.).
• Customer Account : Personal interface allowing access to the services offered.
• Customer: Any natural or legal person who has created a customer account.
• Customer Credit/Customer Balance : Amount available on the customer's personal space to make purchases of services.

Article 3 – Registration Conditions

• Registration is reserved for adultsIn accordance with Articles L221-28 et seq. of the Consumer Code, due to the immediate performance of the services, the customer expressly waives his right of withdrawal.

Any refund request is reviewed on a case-by-case basis according to the following criteria:

• Service inaccessible,
• Defect attributable to By-Hoster,
• Gracious decision of the By-Hoster administration.

Article 10 – Refund

• Customer credits are non-refundable, with some exceptions.
• In case of acceptance of a refund, it will be made via the same means of payment within 14 days, or in the form of credit on the customer area.

Any bank charges and commissions are non-refundable.

Article 11 – Abuse and Disputes

Any abuse of services (DDoS, hacking, attempted intrusion) leads to:

• Immediate warning,
• Temporary or permanent suspension without notice in the event of a recurrence.

In the event of a dispute (including chargeback), By-Hoster suspends all services associated with the account until resolved.

No refunds will be given until the dispute is closed. French law is applicable. The competent jurisdiction is that of By-Hoster's registered office.

Article 12 – Modification of the GTCU

By-Hoster reserves the right to modify these GTCU at any time. Any changes will be made known to customers via the customer area
