General Terms and Conditions of Sale (GTCs)
Preamble
These General Terms and Conditions of Sale ("GTC") apply to sales of services made by By-Hoster, an association registered under RNA number W162005815 and registered under SIRET 92395660100010, whose registered office is located in Nouvelle-Aquitaine, France.
The use of By-Hoster's services implies the unreserved acceptance of these GTCs.
Article 1 – Purpose
The purpose of these GTCs is to define the rights and obligations of the parties in connection with the sale of hosting services and associated solutions by By-Hoster.
Article 2 – Characteristics of the Services
By-Hoster provides various services related to hosting:
- Shared hosting,
- Dedicated or virtual servers,
- Storage solutions,
- Other ancillary services.
- After validation of the full payment,
- Subject to acceptance of these GCS and GCU.
- Service interruptions beyond its control (force majeure, network attack, etc.),
- Fraudulent or abusive use made by a third party of the customer account.
- Access to your data,
- Rectification,
- Deletion,
- Opposition to processing,
- Data portability.

Article 3 – Order and Conclusion of the Contract
The customer selects and orders the services via the customer area accessible on the site.
The order becomes final:
By-Hoster reserves the right to refuse an order in the event of a payment problem or a proven risk of non-compliance with internal rules.

Article 12 – Force Majeure
By-Hoster cannot be held responsible for the total or partial non-performance of its obligations in the event of force majeure, within the meaning recognized by French case law.
Article 13 – Intellectual Property
The content of By-Hoster's sites and services (texts, images, logos, trademarks, etc.) is protected by French and international intellectual property laws.
Any unauthorized reproduction, distribution or exploitation of these contents is prohibited.
Article 14 – Data Protection
The personal data collected is used in strict compliance with the GDPR (General Data Protection Regulation).
